Terms of Service

These Terms of Service ("Terms") are an agreement between you and Viral Engine for use of Invy (the "Service") at invy.viralengine.in. By creating an account or using the Service, you agree to these Terms and our Privacy Policy.

1. Agreement with Viral Engine

The Service is provided by Viral Engine. If you use Invy on behalf of an organization, you represent that you have authority to bind that organization to these Terms. Contact for legal/privacy matters: [email protected].

2. The Service

Invy helps organizers connect Google (Forms, Calendar, Gmail) and optionally WhatsApp Cloud API to automate event registration, confirmations, calendar invites, reminders, waitlist, and related workflows. Features may change as we improve the product. Third-party platforms (Google, Meta) remain subject to their own terms and availability.

3. Accounts

You must provide accurate account information and keep credentials confidential. You are responsible for activity under your account. We may suspend or terminate accounts that violate these Terms or pose a security risk.

4. Acceptable use

You agree not to:

  • Use the Service for unlawful, harmful, deceptive, or abusive purposes.
  • Send spam, unsolicited bulk messaging, or messages that violate Meta, Google, or telecommunications rules.
  • Attempt to probe, disrupt, or circumvent security or rate limits.
  • Reverse engineer the Service except where permitted by law.
  • Misrepresent your identity or affiliation, or collect personal data without a lawful basis and required notices/consent.

5. Organizer duties

As an organizer, you are responsible for your events and the personal data you collect from attendees. Without limitation, you must:

  • Provide accurate event information and keep capacity, schedules, and messaging templates appropriate for your audience.
  • Obtain any consent required for email, WhatsApp, or other messaging, and honor opt-outs and cancellation requests.
  • Comply with applicable privacy and consumer laws for your attendees (you are typically the controller of attendee event data).
  • Use Google and Meta connections only for purposes consistent with their policies and with the scopes you grant.
  • Not use Invy to sell or improperly disclose attendee contact lists.

6. Meta and Google policy compliance

Your use of Google APIs through Invy must comply with Google's terms and the Google API Services User Data Policy, including Limited Use. Your use of WhatsApp / Meta messaging must comply with Meta's WhatsApp Business and Cloud API policies, template rules, and opt-out requirements. We may suspend channels if required to protect the platform or comply with those providers.

7. Intellectual property

Viral Engine and its licensors own Invy's software, branding, and documentation. You retain ownership of your event content, templates, and registration data. You grant us a limited license to host and process that content solely to provide the Service. You may not copy or redistribute our software except as allowed by these Terms.

8. As-available service

The Service is provided on an "as is" and "as available" basis. We do not warrant uninterrupted or error-free operation. Delivery of email and WhatsApp messages depends on Google, Meta, carriers, and recipient settings outside our control. Features such as automated retention deletes may be stubbed or incomplete until separately enabled.

9. Limitation of liability (draft)

To the maximum extent permitted by applicable law of India, Viral Engine and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or business interruption, arising from your use of the Service. Our aggregate liability for claims relating to the Service will not exceed the greater of (a) amounts you paid us for the Service in the three months before the claim or (b) one thousand Indian Rupees (₹1,000), if you use a free tier. Nothing in these Terms excludes liability that cannot be limited under Indian law. This section is a working draft and may be updated after counsel review.

10. Termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms, if required by a platform provider, or if we discontinue the Service with reasonable notice where practicable. Provisions that by nature should survive (including IP, liability limits, and governing law) survive termination.

11. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Courts in India have exclusive jurisdiction over disputes arising from these Terms, subject to any mandatory consumer protections that apply.

12. Changes

We may update these Terms from time to time. The "Last updated" date will change when we do. Continued use after changes become effective constitutes acceptance of the updated Terms.
